    Not a police officer, but reading all the back and forth including the posted old and new 207c parts that has become a hot potato, I see a third side.
    Police officers may be telling each other take the money, just don’t get hurt and you will not have to worry about the 207c clause changes.
    You know who gets hurt then, the very people who pay for everything, taxpayers. Policing is a Very physical job at times and to have an officer have to worry about spending thousands of dollars for representation on new parameters can be a problem.
    Did anyone think about that when you signed?
    Other thoughts come to mind but it is of a personal nature between the city and officers so not my business. Just the one above and the effect on unobstructed service to the community by our brave men and women in blue. Tough job at all angles and I feel the first person who comes back and says he had to spend 10 thousand for a medical claim will dilute the effectiveness of our modern day centurions.

    First of all this has nothing at all to do with like or dislike, love or hate, for our current leaders. Has everybody lost their marbles? Who cares about huge increases to the welfare fund? Last I saw we cops are not reproducing at an alarming rate. It all comes down to dollars and cents. We are basically getting somewhere around 400 and change a month for the last 5 years we worked and not even a thank you to get some sort of retro up front, anything, to make this contract work for the membership. 6.5 percent for our retro years is a joke. And if we all were to except that we should have asked for a little bit up front. If you were stuck on a desert island for weeks without food and someone gave you a plain old stale cracker, you would swear it was the best cracker you ever had. You would swear it was a ritz cracker. When told by your rescuer that is was just a stale old cracker you would not believe it. Well people, the city and PBA just fed you old, stale crakers. When you wake in the morning that’s all it will be. Every other jurisdiction will have the ritz. We just don’t know how dam good a ritz cracker tastes anymore.

    I am relatively new to the job. I don’t fully understand the concept of changing 207C. From what I understand if we get hurt on the job, we can apply for 207C benefits which would give us full pay. If these changes go through the commissioner would have total control over if we should get 207C benefits or not. If denied we get to use sick time, of which we have unlimited. So we would get paid either way. So is a tax change only?

    Dear Keith, After posting this Hezitorial – Blue Truth, I received a call from a resident who suggested that in order for the PBA membership to vote for a contract that is appropriate for them as employees, their family, with respect of the City of Yonkers, a labor lawyer should be hired that has no skin in this game who can read the contract and interpret every aspect within that contract and the ramifications of the written words within that contract and how that impacts the PBA membership and CoY. If you need labor lawyers, I can supply you with three. Their cost may be between $2,000 to $3,000 for their expertise. It is most important that the PBA membership fully understand to what they are signing their name. This is a brilliant idea that did not come from me, but a resident, and I thank them sincerely. The Yonkers PBA can pay for this expertise or the costs can be divided among the membership out of pocket. Out of pocket you are looking at under $5.00 per member. This is leadership at its best.     Review of Disability
    The new procedure gives the Commissioner the exclusive authority to determine the applicant’s continued eligibility for benefits under GML 207-c or to terminate same.
    This is very different from the existing procedure which states that the Commissioner may periodically review cases for the purposes of determining whether the individual continues to be entitled to 207-c benefits, and in furtherance thereof MAY TAKE SUCH ACTION AS IS APPROPRIATE UNDER THE LAW.
    The LAW states that 207-c benefits are a property right to which a member is guaranteed Due Process (a hearing) before that property right can be taken away. This new procedure removes the right to a hearing and gives the Commissioner the sole discretion to terminate 207-c benefits, then triggering the member’s right to seek arbitration over the termination of those benefits.
    Further, if a member or his attorney can’t comply with the duty to commence arbitration within twenty (20) business days, then the member comes off 207-c leave and must utilize his/her accrued vacation, personal and/or compensatory time, or not be paid during the pendency of the arbitration adjournment.
    This is a radical departure from the existing procedures and may result in members having their 207-c benefits summarily terminated during the pendency of an appeal and arbitration process.

    The new procedures unfairly puts the burden of proof on the member, whether he/she is trying to obtain 207-c benefits or prevent the City from terminating his/her previously granted 207-c benefits.
    Under the existing procedures, the arbitrator decides who has the burden of proof in the proceeding.
    Under the existing procedure, if a member is seeking to obtain 207-c benefits then the member has the burden of proof by a preponderance of the evidence that he/she is entitled to receive the benefits set forth in GML 207-c.
    Under the existing procedure, if the City is seeking to terminate a member’s 207-c benefits then the City has the burden of proof by a preponderance of the evidence that the member is no longer eligible for GML 207-c benefits.
    Under the new procedure, “the burden of proof and the burden of going forward shall be on the party requesting arbitration.” The City NEVER requests arbitration, so the BURDEN OF PROOF IS ON THE MEMBER for both types of arbitrations. The City makes the initial determination. If the member doesn’t agree with that decision then the MEMBER files for arbitration. If the member is granted 207-c benefits the City does not file for arbitration to end the benefits, rather the City makes a determination that the member is no longer entitled to 207-c benefits. Upon such a determination, the MEMBER files for arbitration to preserve his/her 207-c benefits.
    This new procedure unfairly puts the burden of proof on the member and the member only, regardless of the type of issue in arbitration.

    Arbitration changes
    The new procedure states that if a member (or his attorney) requests an adjournment of the arbitration (that was scheduled within 20 business days) for whatever reason that results in the arbitration hearing not being able to be commenced within the scheduled twenty (20) business days, then the member (who is on tax free 207-c) comes off 207-c leave and must use any “vacation, personal and/or compensatory time” for the duration of the adjournment.
    As with the arbitrators, most “good” 207-c disability attorneys are very busy and cannot reasonably be available to schedule an arbitration within twenty (20) days. If the attorney must adjourn the arbitration because of an emergency, conflict, unavailability of witnesses/doctors or medical records, then the member will lose his/her tax free status and instead must use his/her accrued “vacation, personal and/or compensatory time” or otherwise not be paid.
    This new procedure severely limits a member’s attorney from adequately representing him/her and presenting a winning case before an arbitrator. That’s assuming that a member can find a competent 207-c disability attorney who would be willing to undertake the representation under these new unforgiving procedures and time frames.

  46. 207-c changes are crazy

    Arbitration changes.
    The new procedure radically changes the arbitration process, from the timing of arbitration, to the selection of the arbitrator, to the determination made by the arbitrator.
    The existing procedure states that once a member demands arbitration (because his application was denied or because the Department is trying to terminate his existing 207-c benefits) that the American Arbitration Association (“AAA”) will forward the parties a list of 7 arbitrators (from their list of hundreds of arbitrators). The City and the member will select a mutually agreeable arbitrator from the list provided by AAA. The member and his attorney get to evaluate each of the arbitrators on their list (just like the City does) and through a process of elimination (with each side striking an arbitrator alternatively) an arbitrator is selected. The Association has nothing to do with the arbitration process as it is between the member and the City.
    The new procedure provides that the Association and the City will create a mutually agreeable panel of 7 arbitrators that will be used for all 207-c arbitrations. There are provisions for selecting and replacing arbitrators who no longer are acting as arbitrators, but there is no provision for either the Association or the City from permanently striking arbitrators that either side doesn’t want on the panel any longer because of their past rulings or practices.
    This new procedure is a major change to the arbitration selection process. If anyone is unsure of how this could potentially affect them, then just place a phone call to one of the several attorneys who regularly represent members in 207-c and disability matters. This new procedure will severely hamper a member’s attorney from selecting a truly neutral and unbiased arbitrator to hear that member’s 207-c hearing.
    The new procedure also rotates the selection of the arbitrators on the 7 arbitrator panel. Arbitrator A will be used first, then Arbitrator B, and so on, UNLESS the next rotating arbitrator is unable to commence the arbitration within twenty (20) business days. If the next arbitrator isn’t available within twenty (20) business days then the next arbitrator available will be utilized. Most “good” arbitrators are very busy and don’t have availability for sometimes months. In effect, this new procedure would result in the assignment of arbitrators who have availability, most of whom are not “good” arbitrators as neither side likes their performances or decisions. An injured member and his/her attorney could be stuck with a very bad arbitrator hearing a critically important issue to that member because of this new procedure.
    In addition, to qualify, the arbitrator has to agree to render a written decision within twenty (20) day of the arbitration hearing. Again, most “good” arbitrators are very busy and even if they are available to hear a case within twenty (20) business days, they may not agree to be on the “panel” because of the commitment to issue a written decision within twenty (20) business days.

    I was reading a post the other day and saw that the referred ratpack were now attacking appearances. Lol, how low can they really go? But I will go a little lower. The Union head can’t really talk about anyone. After all he has to go straight to a sweatshop to have his clothes made, that’s the only places that have enough material. And he looks like that old depressed, 800 pound gorilla, caged at the Bronx zoo. As for the runaway commander, he looks like a crack hoe with his missing teeth, stained shorts and tee shirts and flip flops he wears. He pals around with that runt exec that looks like wee man or a midget wrestler. On to that fucking RAT Brian Moran.   48. 207-c changes are crazy

    The new procedure allows the Commissioner to render a “revised written initial determination” if he/she is made aware of additional information not available to him/her prior to the issuance of the initial determination. The existing procedure does not give the Commissioner the authority or right to change his/her initial determination.
    This part of the new procedure is one of the most egregious and dangerous of all of the changes contained in the new procedure. Once conferred, an intial determination of the entitlement to 207-c benefits creates a “property right” in those benefits. As such, the 207-c benefits cannot be altered or diminished without “Due Process” or in layman’s terms a hearing.
    By agreeing to the new procedure, members are giving up their rights to Due Process and allowing the Commissioner to “revise”his/her initial determination. Obviously, the “revision” would only used to “deny” previously “granted” 207-c benefits.

    The new procedure is still requires the Commissioner to render a decision within thirty (30) days after receiving all of the information required under the procedure.
    There is no reduction in the amount of time the Commissioner has to make his initial determination.
    In fact, both the new procedure and the existing procedure allow the Commissioner to delay his initial determination long after the thirty (30) days by claiming he/she has not received all of the “necessary information” as outlined in Section 7.
    In effect, the new procedure substantially reduces the time frames that the members are subjected to without making a corresponding reduction in time within which the City/Commissioner must act or make a determination.

    The new procedure creates a mandatory disciplinary penalty of the loss of five (5) days pay for failing to appear at a medical examination or multiple examinations that the Commissioner has total discretion to schedule without consultation with the member.
    This new procedure basically gives the Commissioner the unlimited ability to harass and punish individual members and striping the member from many of the protections of the disciplinary procedures in Appendix E of the Collective Bargaining Agreement.

    The new procedure substantially reduces (by approximately 50%) the time within a member can make an application for 207-c benefits.
    Failure to file the application within this much shorter time period will result in the application being deemed “untimely” and therefore gives the Commissioner additional discretion and cause to deny an otherwise justified application

    The new procedure requires the member to authorize the City to the unlimited access to the member’s entire confidential personal health information, including confidential personal health information that is unrelated to the injury/illness that is the basis of the member’s 207-c application.
    The existing procedure only allows the City to access medical records pertaining to the specific injury/illness that was the basis for the member’s 207-c application.
    Thus if a member were to apply for 207-c benefits for a shoulder injury, the new 207-c procedure would allow the City to have access to the member’s full medical history, including non- work related injuries, illnesses, conditions, etc., such as maternity, reproductive problems, sexually transmitted diseases, or other sensitive personal health information.

    The other long-term contracts agreed to by other unions had better raises, immediate retro and didn’t make wholesale changes to important items like. 207C.
    This just proves that Andy Quinn has no business advising unions on labor law issues. He may be ok with criminal defense work, but he’s no labor lawyer.
    Time to vote this lopsided contract down and get a real labor lawyer representing us.

    In case anyone forgot, Mile Spano has to run for re election in 2015. Does anyone really think he wants to run for Mayor with all expired contracts and every union in the city against him? His opponents will destroy him.
    We have Mike Spano by the balls. If anyone in the PBA had a pair of balls they would squeeze Mike’s balls and take advantage of his desperation to get contracts resolved now.

    One of the other frequent questions I am hearing is “what happens if the PBA votes the contract down?”(WE WORK HARDER AT THE TABLE AGAIN) The answer to that is in all likelihood we move towards arbitration. It is our opinion that the deal we have on the table is the best the city is going to offer.(LIAR LIAR PANTS ON FIRE) If we didn’t feel that way, we would still be at the negotiating table, plain and simple.(YOU ARE TRYING TO PUSH THIS SO YOU CAN STAY PBA PRES RAT FUCK) The CLSA will likely be signing an MoA in the very near future.(BULL SHIT TOMMY SAID HIS MEMBERS ARE NOT CRAZY FOR IT OTHERWISE HE WOULD OF BEAT YOU TO THE PUNCH LIKE HE ALWAYS HAS!)     I am not sure what YFD Local 628 will do, but that is not my concern.(WHAT THEY WILL DO IS GET A MUCH BETTER CONTRACT THAT IS A PROMISE WAIT AND SEE MEMBERS0 In their case the CoY wants to go to arbitration and it is the City that has filed for impasse. Again, not my concern, but I wish them all the best of luck.(THEY DONT NEED LUCK,THEY HAVE A PROFESSIONAL LEADER UNLIKE YOU THAT ALWAYS LOOKED OUT FOR THEM,AND MOST IMPORTANTLY THEY ARE BEING PATIENT UNLIKE YOUR RAT ASS TRYING TO BAMBOOZLE US WITH THIS SHIT CONTRAT)
    So what happens if we were to go to arbitration? By law, the arbitrator can only offer a two-year award, unless both sides agree to a 3rd year.(I WILL TAKE MY CHANCES WE WILL GET MORE THIS IS THE FIRST DEAL MIKE THROWS AT YOU AND LIKE THE RAT YOU ARE YOU TAKE IT ????MAYBE ANOTHER JOB FOR A FAMILY MEMBER?) In this case, the CoY would not. The arbitration process is slow and would likely take us into 2015.(LIAR LIAR) It would give us an award for 2009 and ‘10, which would still leave us almost 5 years behind on a contract again.(BUT AL LEAST WE WILL GET A BETTER CONTRACT)
    It is also important to remember that the rules to binding arbitration changed at the end of the last NYS Legislative year. The new rules mandate that if a municipality is fiscally distressed (like Yonkers) the arbitrator has to base most of his decision (70%) on the City’s ability to pay. We would probably be the first union to go to binding arbitration under these new rules and we would be the test case. We would also risk losing things in our contract that are extremely beneficial to us.(WE ARE LOSING MORE THAN ANY OTHER UNION IN THE COUNTY SO FAR RAT ,STOP SCARING THE MEMBERS,THE CITY IS NOT IN BANKRUPT,THEY GOT PLENTY OF MONEY,YOU FORGOT ALL THE SPECIAL UNITS YOU HELPED SHUTDOWN)!!!
    When the CoY was offering 5 zeros, binding arb was the only choice. Now that the offer is a 23.5% raise (more than 26% compounded) over 10 years with tremendous increases to the welfare fund and uniform allowance and virtually no givebacks for current members, arbitration is clearly not the choice.(BULLSHIT 23.5% OVER 10 YEARS IS NOTHING COMPARED WHAT IT COST TO LIVE THESE DAYS,BUT YOU MY RAT FRIEND DONT CARE CAUSE YOU DONT PAY TAXES ON THE 4K STIPEND YOU GET EVERY MONTH,YOU GET FREE GAS,YOU GET A TAKE HOME CARE ,PLUS YOU USE OUR CREDIT CARD TO EAT YOU FUCKING RAT FUCK,SO OF COURSE THIS CONTRACT IS A GODSEND TO YOU BUT HELL FOR US !!!
