YONKERS, NY — August 9, 2017 — A Special Meeting of the Yonkers City Council was officially noticed on Monday, August 7, 2017 to advise of eight items to be discussed on Tuesday, August 8, 2017. Item number five was defined as follows: 5. RES – SETTLEMENT $1,250,000. – IRMA MARQUEZ AND CITY OF YONKERS. (FISCAL IMPACT – AMOUNT OF SETTLEMENT – NEGATIVE FISCAL IMPACT.)

The Yonkers City Council voted unanimously to approve the settlement by the six attending members; Councilman Dennis Shepherd was absent.

Gary Certain, partner in the Certain & Zilberg, PLLC law firm wrote the following: “This settlement serves as an acknowledgment that Officer Wayne Simoes’ misconduct was the cause of the injuries that continue to effect Ms. Marquez. However, the wrong message is sent to the local community and a sense of injustice remains in that the Yonkers Police Department, the members of which are sworn to protect and serve, instead of terminating or even disciplining Officer Simoes promoted him to Sergeant.”
