Manufacture, sale and storage prohibited.

It shall be unlawful to manufacture, store or sell fireworks, as defined in § 270.00 of the New York Penal Law, in the City of Yonkers.

§ 59-106

Use of fireworks; permit; fee.

A. 

It shall be unlawful to use, discharge or cause to be discharged, ignited, fired or otherwise set in action any fireworks in the City of Yonkers unless a permit is issued by the Commissioner pursuant to § 405.00 of the Penal Code of the State of New York.

B. 

No permit shall be issued pursuant to Subsection A of this section unless the applicant pays the permit fee.

Disposal of unfired fireworks.

Any fireworks that remain unfired after the display is concluded shall be immediately disposed of in a way safe for the particular type of fireworks remaining.

Thank you sincerely to the shopper that recognized the fireworks display at Costco’s, recognized it was not a display appropriate in the City of Yonkers, snapped the photos  herein, sent it to the Yonkers Tribune and will likely have saved lives by making thc City of Yonkers (CoY) aware that the display must be taken down, and recognizing that it is illegal to sell fireworks in CoY. Thank you for making the time to inform CoY of this potential hazard.

    The County had the opportunity to “opt out” of the NYS law that automatically “opted in” counties by allowing them to do nothing, consequently allowing the sale of fireworks in Westchester County. The Westchester County Association of Fire Chiefs requested the County opt out but were told that vendors had already placed their order and bought fireworks for the July 4th holiday and would act after that date. They were willing to put profits before safety! Very sad state of the county especially with new leadership.

  2. Why be Hypocritcal ? Paid firemen all live in volunteer towns !

    The two Yonkers Fire Dept union baldies live in volunteer fire towns.
    How hypocritical is this ?
    They will be watching Public fireworks in there (responsibly financially managed) “NON-YONKERS” Home Towns this 4th of July.
    Yes, their hometowns are volunteer fire towns. Keep those taxes down.
    Yonkers must look into a volunteer fire department like the rest of westchester.

      I can’t imagine that a volunteer fire dept would work in a City as big and complex as Yonkers. Maybe in some of the surrounding burbs but not here.

    Just a question for the editor are you citing the New York State Fire code or the city of Yonkers fire code? because the city of Yonkers Fire code has not been submitted to the state for approval so therefore it really has no legal standing but it’s been enforced for god-knows-how-long.

      I was quoting the City of Yonkers Fire Code. I will check on Monday if it holds Legal standing or not, even if it has been enforced. If the law has yet to be accepted by New York State, I should hope it is either rescinded, which would be insane, or better yet, sent for validation and authorization by NY State. thanks for bring the issue up for questioning.

  6. Fireworks Safety Must Be Priority # 1

    Fireworks Safety has to be the highest priority during this time of the year. Leave it to the Professionals. Go to one of those shows that are amazing, run by licenced companies that know what they are doing, and make it a fun and safe experience for all. We also need to be very safe against firefighters who needlessly assault citizens, regardless if they are on or off the job. As a YFD Firefighter or Fire Officer, your representing our city 24/7. We also need to remain safe from officials from those unions, who ‘blow up’ like a M-80, when it comes to padded pensions, that they use loopholes in shady contracts, negotiated by buffoons. Maybe the YFD needs an ordinance against Hot Heads, Chief John ‘Mr. Clean’ Flynn or Barry ‘Mr. Magoo’s McGoey? Those two are as hot as a fire-cracker.
