Yonkers Police Investigate Assault Incidents; Subjects Arrested

On Monday, June 11, 2018, at approximately 2 AM, members of the Yonkers Police Department responded to Rory Dolan’s Bar & Restaurant at 890 McLean Avenue on a report of a fight with an injured party. Upon arrival officers located the victim, a 45 year old male resident of Yonkers, bleeding from the head. Officers rendered medical aid and facilitated his transport to a local area hospital via ambulance to be treated for his non-life threatening injuries.

The victim related to officers that he was sitting at the bar when another male sat next to him and began to encroach his personal space over a period of time. This escalated into a dispute then physical violence, resulting in the suspect striking the victim about the head with a bar stool. As a result the victim suffered the loss of a tooth and required 23 sutures to close a laceration to his head. The suspect and members of his party then left the scene.

At approximately 4:12am, the same morning, members of the Yonkers Police Department responded to the City Lights Gentleman’s Club at 767 Yonkers Avenue on a report of an assault. Upon arrival officers located the victim, a 31 year old resident of Yonkers, down on the sidewalk in a semi-conscious state and bleeding from the head. Officers rendered medical aid and an ambulance was called to transport the victim to a local area hospital.

Information was developed at scene that several men attempted to gain entry into the club which was closed for business due to the late hour and employees were exiting the premises. The men engaged in a dispute with the victim outside the club, at which point one of the men punched the victim in the face causing him to fall down backwards on the sidewalk striking his head against the pavement. The men then left the scene as employees called the police. The victim was admitted to the hospital with head and brain trauma.

Bogdan Kosilov a 25-year-old resident of Yonkers NY and probationary Firefighter with the Yonkers Fire Department, was arrested yesterday’s night.  June 12th and charged with one count of Assault 2’, a Class D Felony of the New York State Penal Law, with regards to the incident at Rory Dolan’s Bar & Restaurant.

Christopher Mitchell, a 41-year-old resident of Highland Falls NY and Fire Lieutenant with the Yonkers Fire Department, was arrested today June 13th and charged with one count of Assault 3’, a Class A Misdemeanor of the New York State Penal Law, and one count of Harassment 2’, a Violation of the New York State Penal Law, with regards to the incident on Yonkers Avenue.

Kosilov was arraigned in Yonkers Criminal Court and released on his own recognizance; his next court date is scheduled for June 18th. Mitchell was arraigned in Yonkers Criminal Court and released on his own recognizance; his next court date is scheduled for July 5th. Both cases are being prosecuted by the Westchester County District Attorney’s Office.

Administration officials have terminated Kosilov’s status as a City of Yonkers employee; Mitchell has been suspended pending an internal investigation. Further inquiries regarding personnel matters are directed to the Yonkers Fire Department and Office of the Mayor. As these are active investigations, no further information will be released at this time.

        Guys stop acting like police. Stop airing what you perceive to be dirty laundry on here. Mitchell made a huge mistake and I am sure the department will deal w him properly. We have all made mistakes but attacking him when he is down does nothing but demoralize the entire job. We should be concerned that 5 of our brothers are getting demoted in 2 weeks. We are the only union in the city that had any demotions and or lay offs. Let’s stop the bickering on here and work w Flynn to make sure these demotions go through.
        I’m proud of both of our unions and what they have accomplished w this administration over the past 7 years. I’m a proud YFD member and City of Yonkers resident who wishes that Chris gets his due process and that these 5 guys don’t get demoted. The stronger we stand together the better we are. Thanks to John and Barry for ALWAYS protecting the members , now let’s stand together for the next 17 months till we have a new administration. If we have learned anything over the last 7 years is how important it is that we select and back the next right candidate, for mayor. Election season starts in a short 4 months away. I implore you to back your unions 100% and give as much time as possible and we will be much better for.

    Based on the details of the above story. To hell with them.
    Anyone not intelligent enough to keep out of this sort of trouble, especially while on probation, deserves what he gets. Even if he is found not guilty, the job is and should be gone, due to his stupidity.
    I do not know what to say about the Lt, except to wonder that if this is how much he values his career and reputation, what good is he to the department?

      How are you so sure of anything until the case is done? What if they were provoked? What if they were assaulted first? We don’t know anything as of yet. I don’t think someone should lose their job if they were simply defending themselves.

        Dear Anon, I agree with you almost entirely- see the “based on the details of the above story” part. I am not saying that legally either is guilty of a crime.

        Still, if one is on probation, one should know the risks of involvement in anything like this. My guess is that there was no life or limb situation in the restaurant that night that called for a physical response. Guy takes a swing at this kid, the first thought that should go through his head, “Is this worth my job and all the benefits that go with it?” If the answer is “no,” then just walk away.

        Again, even with the Lt. He had his guys with him. Unless the other guy pulls a weapon, just walk away. And if he pulled a weapon, and you are unarmed, run away. Not worth the trouble.

        I am not saying defending oneself is not justified, but when one has a descent gig, one always has to think, “is it worth it?” Look at the average bloody street brawl, who is usually involved? People with no investment in themselves nor society, and nothing that can be taken away.

        I have had many situations, where an escalation was entirely justified, then I think, “do I want this guy living in my house, spending my savings, or at a minimum do I want to spend the next two years dealing with his ambulance chasing lawyer? …Just walk away.

        Two last points.

        Responding to an assault -justified, unless you happen to be police or fire, and then be prepared to kiss you career and reputation goodbye. It is what it is. Welcome to the real world, both groups should be smart enough to know they are going to be crucified, no matter how it played out.

        Being Provoked? What are these guys tigers?
        “Hey, did you see that tiger attack that guy?”
        “Yes, but that guy was provoking that tiger.”
        “Oh, that’s different then, I mean he is a tiger and he was being provoked.”
        See if replacing tiger with firefighter still makes sense.
