Ed Koch Commentary: Illegal Aliens Now in Federal and State Prisons and Municipal Jails Should Be Deported To Their Countries of Origin Immediately By Edward I Koch

Koch_Ed I have a proposal which I hope the Obama administration will consider and implement. 

Immediately or as soon as possible the United States should deport all illegal aliens who are now in our federal and state prisons, and in our municipal jails, to their countries of origin.  In 2005, the Government Accountability Office (GAO) issued a report on the number of illegal aliens incarcerated in the United States.  The report stated, “They were arrested for a total of about 700,000 criminal offenses, averaging about 13 offenses per illegal alien.  One arrest incident may include multiple offenses, a fact that explains why there are nearly one and half times more offenses than arrests.  Almost all of these illegal aliens were arrested for more than 1 offense.  Slightly more than half of the 55,322 illegal aliens had between 2 and 10 offenses.  About 45 percent of all offenses were drug or immigration offenses.  About 15 percent were property-related offenses such as burglary, larceny-theft, motor vehicle theft and property damage.  About 12 percent were for violent offenses such as murder, robbery, assault, and sex-related crimes.  The balance was for such other offenses as traffic violations, including driving under the influence; fraud – including forgery and counterfeiting; weapons violations; and obstruction of justice.  Eighty percent of all arrests occurred in three states – California, Texas and Arizona.  Specifically, about 58 percent of all arrests occurred in California, 14 percent in Texas, and 8 percent in Arizona.”

The GAO reported that the number of convicted criminal aliens incarcerated in federal prison on December 27, 2003 was 46,063 and the number incarcerated in state prisons and local jails was 262,105.

According to the Colorado Alliance for Immigration Reform, “Today, criminal aliens account for about 30 percent of the inmates in federal prisons and 15-25 percent in many local jails.  Incarceration costs to the taxpayers were estimated by the Justice Department in 2002 to be $891 million for federal prison inmates and $624 million for inmates in state prisons [annually].”  Every year, about 600,000 of those incarcerated, not limited to illegal aliens, are released and within three years, two-thirds become recidivists and are back in prison.

My proposal would make many of these people the problems of their countries of origin.  Those countries would be given the authority to put whomever was turned over to them back in prison or fine them or place them on probation or otherwise free them.  Since many of these people are drug offenders, and Mexico and several other Latin American countries have changed their laws and decriminalized the personal use and possession of hard drugs like cocaine and heroin, many of those turned over to them who received harsh Rockefeller drug laws sentences of four to 16 years may qualify in Mexico and elsewhere for instant release.  Why should we care?  In the Netherlands, they legally sell marijuana in coffee shops.  Each country today makes its own rules, irrespective of international treaties governing the issue.  Our approach to controlling drug use is certainly not a phenomenal success that would allow us to lecture the rest of the world on how to control substance abuse.

Of course, a determination would have to be made on not releasing those who were convicted of acts of terror against the United States, who remain a danger to us.  Even there we have released to friendly countries those we considered terrorists and seen them released in their own country, rather than serving out their prison terms in their country of origin.  Of course, there would need to be special U.S. courts provided where applications could be heard from those believing that they should not be expelled because of special circumstances and mitigating factors such as family, particularly American-born children and American spouses in the U.S.  There should be provision for hearings and right of appeal to a federal circuit court.  I suggest the rules of evidence be softened so as to allow hearsay evidence to make it easier for the individual being expelled to their own country to make their case for the application of compassion or simply to correct facts.

If it is possible to do this by administrative action and as quickly as possible, I would hope President Obama would take that course.  If it is not solely within his power, then the President should ask the Congress to provide him with the powers needed.

The State of California has been ordered by a federal circuit court to reduce its prison population by 40,000 inmates within two years.  If it does not, California may face the situation when it will be forbidden by federal court order from imprisoning any new persons until it has reduced its prison population by that number.  We know that California has just seen a prison riot which injured hundreds of inmates – mostly by the acts of other inmates – and attributed by many commentators to overcrowding and racism exhibited by the inmates towards one another.  If the Congress cannot by law place the state prison systems into this program, then allow states the option of participating.

Perhaps there are states who will not want to participate and would prefer keeping the illegal aliens in their state prisons and jails, ultimately to be freed and allowed to return to society, but I doubt it.  I don’t expect to see those who believe in the concept of open borders join me in supporting this proposal.  Those who believe that illegal aliens are simply migrants with the right to come and go across borders as they choose and those who are opposed to our building a security fence on our borders to help control those borders and those who believe the Secretary of Homeland Security, Janet Napolitano is currently too harsh in arresting illegal aliens in their workplaces, will oppose those proposals as well.

Nevertheless, I believe the proposal is reasonable and practical.  Why didn’t people think of it a long time ago?  They probably did and the country wasn’t ready for it.   Today, we are.

  1. Yes, but immigrants that came when my family came from Ireland did it legally. Just like the European countries do it now. It just seems to be the immigrants from Mexico that feel they are special. They sneak in, hurry and cross the boarder so their offspring will be automatic citizens, get free medical care, free breakfast & lunch at school, and don’t even bother to learn English. I used to work in the ESL (English as a 2nd language) class at a junior high. I was the English speaking aide. If the student didn’t bother to learn Enlish, they could’nt converse with me. We had children from India, Japan, Romania, & Argentina, that were so happy to be in this country. They were so happy to learn our language, and be a part of the American society. Everyone but the Mexican children. They were lazy and expected the teacher and myself to cater to them not learning English. The Mexican immigrants need to be treated the same way all other immigrants are treated. No special treatment, and if they sneak in the border, they get sent back home. We need to go back to the immigration raids, and make the employers take responsibilty for hiring them. I could go on and on…

  2. Its time to re-examine instant citizenship (Anchor babies) which hasn’t been illuminated enough, to growing concern of the American public. For decades now pregnant women have arrived on tourist’s visas, through the fence and even at ports of call. Very aware of our mis-interpreted law governing “birthright citizenship”, that attributes full rights to the Mother of an illegal immigrant. How can Americans benefit from this Health care reform package, when we must subsidize millions of households and not just the original interloper? Outlined in the spring issue of the Journal of American Physicians and Surgeons is an article that will stun a prudent person. An illegal alien entered the states in 1997 to work as a fruit picker, bringing with him his wife and three children; all illegal aliens.
    The lady gave birth to a fourth child, and with that birth the family had an “anchor baby”—an American citizen by birth, who provided the entire family with a free pass to remain in the United States permanently and collect government, subsides. Unfortunately the baby was born prematurely, spent three months in the neonatal incubator, and cost the San Joaquin Hospital more than $300,000. Meanwhile, the oldest daughter married an illegal alien and gave birth to her own anchor baby, and then Cristobal’s wife gave birth to yet another baby. ALL PAID FOR BY—YOU!
    This is just one taxpayer example of the ‘Rule of law’ that has cost taxpayers billions of dollars. A nurse admitted last weekend, according to Review-Journal reported that cash-strapped UMC hospital in Nevada is providing more than $20 million a year in emergency dialysis care for uninsured, illegal immigrants. Is American society insane when poverty stricken Americans are turned away, go bankrupt and sometimes die? TAXPAYERS ARE TAXED FOR THIS, BUT NOT FOR OUR OWN PEOPLE? We must insist that a Birthright Citizenship lawsuit be filed with the federal court and its original intent revisited? That E-Verify should be fully funded and a highly skilled MIT team, building on the original Immigration enforcement database to a highest level of security that cannot be compromised by the use of fraudulent documents.
    The PC oriented application must be installed permanently on every business computer across this country? ICE should have the manpower to audit every workplace, with the power to arrest and detain employers who snub immigration laws? Repeat offenders should be dealt with harshly, including prison and confiscation of business assets. There should be no mitigating excuses because illegal immigrants are—STEALING JOBS– on any rung of the employment ladder? These employers for years have been an intended magnet for destitute labor in many cases, but have left the burden of paying for schooling for the children, health care and a veiled miscellaneous core of government handouts to US taxpayers. THIS IS NOT ABOUT RACISM, BUT AN ULTIMATE FINANCIAL MATTER OF SURVIVAL FOR US ALL! Coincidentally, I want a government health care, specially for some low income American family members.
    Insist your politicians guarantee E-Verify is fully funded and is not scuttled by Sen. Harry Reid, Nancy Pelosi, Janet Napolitano or any other high ranking Democrats. Why should we have two different rule for people.The usa should not reward illegal behavior, lets start with bush and dick cheney, wall street,big pharma,etc.
    If you are native American your are alien to this shores so lets not get it twisted.what if martians came over and overnight we all became second or third class citizens, and we cant kick their asses like we do everyones,what next? There was once the Mongolian empire,Roman empire,british empire,russian,the vikings spanish etc.they are all gone,and this too will surely pass and you can take that to the bank.What kind of karma would you want your descendants to experience?

  4. Illegal immigrants should be charge $$$ for entering this country illegally & must be deported. It’s useless to have countless rules at the airport for security if the USA will grant illegals to enter this country without penalty.
    I am sick of my tax $$$ being use to pay for illegal babies. Women that enter this country illegal should not have the right declare the child an citizen. The USA should not reward illegal behavior but punish individuals that do not obey the law.

  5. Oklahoma has a new law and is now deporting illegals from our prisons. It will save the state hundreds of thousands of dollars. Violent offenders should be forced to serve out their terms but the rest need to go back. It would be a good plan if they would actually secure the border so they can’t come right back.

    I am sorry I didn’t see this comment sooner. If the only good foreigner is a dead one, and you are not likely aNative American Indian, you too would need to “dead” to agree with your sentiment. There must be validity to who you are, as well as to others. We need to learn to speak to one another to mitigate issues of concern or behavior. Unfortunately, our leaders are weak in this regard. That is we we all suffer, each from their own perspective.
    This is a good forum in which many ideas are discussed freely. Please consider doing the same. I would sincerly appreciate that.

Read our lips,no one is against LEGAL immigration.America has more legal immigrants coming into this country every year than any other country in the world,but a country that would give ILLEGAL immigrants the same right as LEGAL immigrants would not exist as a nation.No borders,no country!The only good Democrat is a defeated Democrat.

  8. Ira and dinada, you got it! I, too, agree that Koch must have been drinking something awfully potent when he commented the way he did. First of all, a plea to Pres Obama goes unheard b/c Congress is the body that will make the changes, not the Prez. Just thought after reading this that we surely don’t pay these officials to think, eh?

  9. I’m always blown away by the high level of misinformation commentaries such as Koch’s and responses such as those above offer, to say nothing of the bludgeoning of the English language.
    I wonder if these folks are aware that they’re way off base from any reliable studies that have been done and just figure the rest of us won’t notice; or are they fully aware and shamelessly single-minded in their campaign to cleanse this country of the very people who have made it as strong as it is…our generations of immigrants.

  10. A full third of California’s prison population is illegal aliens. The Cali courts have ruled prisoners must be released. The illegals should be turned over to Mexico.

  11. NO! Bad Idea. Illegal alien prisoners should serve their entire sentences before being deported.
    As Rep Elton Gallegly noted in a far better assessment of what to do with foreign criminals (http://tinyurl.com/n7q3lb), “In 2008, about 1,600 — or 1 of every 7 — criminal illegal immigrants deported from California were caught committing a crime in California within the next year.”
    The biggest crime deterrent America has is tough punishment. Releasing prisoners to save money sends the wrong message entirely.
    And many of those dangerous criminals will be back here in short order to avail themselves of America’s riches.

  12. Look their should be a law for politicians, when your out of office keep your mouth shut. If you couldn’t manage to do it when you were in office, you were useless and now please shut up.
    We should regulate immigration now more than ever. Remember all of the fear from the Bush era, from checking out your neighbor to duct taping your windows. All this fear and yet he kept the borders porous. Sickening that this bastard got away with what he got away with. If terrorism is such a threat, all of this illegal immigration talk is a no-brainer. However it is all smoke and mirrors.

  13. Wait a minute! Is this the same Ed Koch, who as mayor of New York City made it a sanctuary for illegal aliens? The same Ed Koch who barred police from asking questions about immigration status, and declared that no questions about immigration status would be asked when doling out public benefits?
    It is wonderful that Hizzoner has seen the light, but true redemption begins with aknowledgement of our own culpability. During his time in office, Mayor Koch was part of the problem he is now lamenting.

  14. I agree 100% and so do many others I have spoken with. Illegal is illegal. Not only the prisons, but get them off our streets as well. They don’t belong here and I am sick of my tax dollars taking care of them and their families. It would be nice to help out our own people. Why can’t my son have medical help and schooling when I’ve paid taxes for 30 years. That’s unheard of- to help our own . They get everything and anything and it’s gotta stop now. If All the funds that are spent on illegal aliens were put into helping legal citizens, we would not be crumbling like we are.. They have taken over. It’s a fact!

  15. Koch’s idea won’t work until and unless we really seal off the borders correctly. Jack Treacy is right to the extent that many of these vermin will just sneak back in otherwise.

Koch has lost his reality reasoning.If the illegal immigrant criminals are released to country of origin, they will be back in this country illegally again committing crimes.I got better ideas send the prison cost bills for prisoners and health cost bills for prisoners and non-prison illegal immigrants to their country of origin to pay.No pay,no trade with America.
