Murtagh Will Call on Council to Defer Action on Board of Ed. Capital Funding Request; Intervene in Lawsuit 

Yonkers, NY — Responding to a lawsuit filed by the Yonkers Board of Education which seeks to block the Yonkers Inspector General from auditing the books of the Yonkers Board of Education, Councilman John Murtagh (R-5) said today that he will call upon his City Council colleagues to defer approval of the Board’s $25million dollar borrowing plan which the Council was to have voted on next Tuesday. The Board of Education, in a recent change of policy, has taken the position that it is not subject to the jurisdiction of the Inspector General. It was recently disclosed that on September 29, 2009 the Board filed suit in New York State Supreme Court seeking a declaration of its right to deny review of its books and records.

“As elected officials we are responsible to the taxpayers for knowing how their money is spent” Murtagh said, “ our school system receives nearly half a billion dollars in taxpayer money every year yet refuses to open its books to review. Until the Board of Education is prepared to acknowledge the taxpayers’ right to know how their money is spent we cannot in good conscience continue to allow the Board to just borrow and spend”.

“The Inspector General conducts audits and investigations at the request of the Mayor and the Council”, Murtagh noted. “The Mayor and the Council answer to the citizens and taxpayers. Thus, the School Board has really filed suit against the people of Yonkers. Until we get a satisfactory answer to why the Board refuses to open its financial books and records, we should not continue to hand it blank checks”.

Murtagh said he would also be submitting a Resolution to the Council urging that it instruct its attorneys to move to intervene in the Board’s lawsuit in support of the Inspector General.

“Year in and year out our Trustees and Superintendent cry poverty, yet they now find the money to hire a Manhattan law firm to bring wasteful and counter-productive litigation against the City”, Murtagh concluded. “Their actions are frivolous and wrongheaded and, worse, jeopardize the interests of our school children”.

  1. I agree with Jailhouserock, BOE probably has retired spouses who should be on COBRA, but Yonkers is still picking up the tab to millions. But there could be ghosts too, friends and family getting health ins. this is something to look at!

  4. isnt it funny that it hist the NY POST 2 weeks ago on the cover about selling our public schools to the highest bidder to build out the new school plan, along with the Tappanzee Bridge & other construction projects, they want to privatize the schools to investors of over $1bb then give them tax dollars to repay them….
    what is going on here guys?

  5. This is a side issue, but relevant in its own way. It has been reported and confirmed that the state tests have been “dumbed down” so much that even a goldfish could pass them.
    Bloomberg in NYC is taking a lot of heat over this. But all you hear in Yonkers is Pieorazio bragging about state test scores improvement –even though the deck has been stacked. MORE dishonesty.

  6. Poorarzio is amicones boy, he does what phill says, so what is going on here. Amicone is behind this, if not, he can pick up the phone and tell poorarzio to open the books, poorarzio is doing what amicone wants.

  7. The ‘summons” is childish..nothing more and nothing less.
    Instead of focusing soley on legal issues, it accuses the Inspector General of an “UNLIMITED INQUISITION.” WOW
    While some of the people at the BOE should be burned at the stake, the termonology is a bit overwrought.
    The fact is the BOE should ACT like it is in a partnership with the city, its parents and its children. It should not waste taxpayer money on lawsuits, invective and threats. Its action simply beg the question: what are they hiding?
    The City Council, as representiatives of the People, have standing in this lawsuit and should be part of it; Murtagh is absolutely correct. The BOE is arrogant, feels it owes nothing to everyone, and has to be brought down to earth.
    Spending the Children’s money for this arrogant lawsuit to prove theirs is bigger is a negligent, fraudulent waste of taxpayers money, and a violation of their fiduciary obligation to the children of Yonkers.
