Governor Cuomo Announces Passage of Marriage Equality Act

Governor Andrew M. Cuomo today announced passage of the Marriage Equality Act, granting same-sex couples the freedom to marry under the law, as well as hundreds of rights, benefits, and protections that have been limited to married couples of the opposite sex.

 

"New York has finally torn down the barrier that has prevented same-sex couples from exercising the freedom to marry and from receiving the fundamental protections that so many couples and families take for granted," Governor Cuomo said. "With the world watching, the Legislature, by a bipartisan vote, has said that all New Yorkers are equal under the law. With this vote, marriage equality will become a reality in our state, delivering long overdue fairness and legal security to thousands of New Yorkers."

"I commend Majority Leader Dean Skelos and Minority Leader John Sampson for their leadership and Senator Tom Duane for his lifetime commitment to fighting for equality for all New Yorkers," Governor Cuomo continued. "I also thank Assembly Speaker Sheldon Silver and Assemblyman Danny O’Donnell for ushering this measure through their chamber."

The Marriage Equality Act amends New York's Domestic Relations Law to state:

  • · A marriage that is otherwise valid shall be valid regardless of whether the parties to the marriage are of the same or different sex
  • · No government treatment or legal status, effect, right, benefit, privilege, protection or responsibility relating to marriage shall differ based on the parties to the marriage being the same sex or a different sex
  • · All relevant gender-specific language set forth in or referenced by New York law shall be construed in a gender-neutral manner
  • · No application for a marriage license shall be denied on the ground that the parties are of the same or a different sex

The Marriage Equality Act was amended to include protections for religious organizations. The Act states that no religious entity, benevolent organization or not-for-profit corporation that is operated, supervised or controlled by a religious entity, or their employees can be required to perform marriage ceremonies or provide their facilities for marriage ceremonies, consistent with their religious principles. In addition, religious entities will not be subject to any legal action for refusing marriage ceremonies. The Act will grant equal access to the government-created legal institution of civil marriage while leaving the religious institution of marriage to its own separate and fully autonomous sphere. Additionally, the Act was amended to include a clause that states that if any part is deemed invalid through the judicial process and after all appeals in the courts, the entire Act would be considered invalid.

The Act was made a reality thanks largely to New Yorkers United for Marriage, a coalition of leading New York LGBT rights organizations who have fought so that all couples in New York have the freedom to marry. The partners include Empire State Pride Agenda, Freedom to Marry, Human Rights Campaign, Marriage Equality New York, and Log Cabin Republicans.

    likely to be child molesters than heterosexual
    adults…but the stats demonstrate that there is
    absolutely no basis for that belief..right wingers
    make shit up that fits their notion of what they
    believe is right and wrong….they are entitled to
    their own opionions but not their own facts

Do you think we have forgotten how Jim Surdoval was let off the hook. It wasn’t bias bigots or clergy that did that was it.

    constructive criticism in the spirit in which it is
    given…but rhino or rino….you can’t win without
    those of us who are not ideological nut jobs and
    who view issues based on facts not bias and prejudice
    or what rush limbaugh tells us to believe…bottom
    line is that the conservative party chairman was
    totally disregarded and the senate majority reflected
    the majority of voters in this state..I am really tired
    of those on the right side of the republican party
    dictating to me who is and who is not a real republican
    I was a republican before they knew what a republican
    was…barry goldwater would be ashamed of where the
    party now stands on social issues..he would be ashamed
    that people like bachmann and palin command so much
    attention and support…but the primary reason is
    that unfortunately the level of education possessed
    by those who support these kinds of republicans is
    extremely low…their knowledge of history and economics is practically non existant and their
    inability to think for themselves is evident in the
    callers to the talking head shows which simply
    regurgitate what the talk show hosts have said over and
    over and over…but here is the bottom line…
    nominate bachmann and you will re elect obama..
    nominate only those who toe the line on gay marriage
    and you will elect democrats…your choice

Anon, I believe he was using the term RINO (Republican In Name Only) In your post, you used the word Rhino (The rhinoceros is a large, primitive looking mammal that in fact dates from the Miocene era millions of years ago) All though I could see how you would think someone would refer to you as a RHINO, I think the above poster actually meant RINO.
    when that poster also wrote “You’d be applauding a law that let some pervert marry a chicken. ” that poster is clearly not talking about the law that was just passed. You see, anon, “You’d” is a contraction for “You would” in other words, that poster is saying that if a law was put forth that allowed a man( pervert) to marry a chicken, YOU WOULD (You’d) applaud it becasue your morals are so askew.
    Now the English lesson is over, you may go back to suing people for frivilous claims 🙂

  6. Jack you are so concerned about homosexuals adopting children, why they unlike very many catholic priests, are not pedophiles. Where was you outrage when the scandal with the church came out. Supposed men of god who violated their vows, no comment on that. Everyday you read articles about child abuse and the hands of mothers, fathers, mothers boyfriends no comment from you. You are a hypocrite, a homophobic and a bigot. I applaud the 4 republican who stood up to Mike Long.

    animal you can’t read…a majority of the republicans
    in the state senate voted for it in the face of threats
    and tantrums by the conservative party chair…they
    stood up for what they believed was right…are they
    all rhino’s and your the only true conservative because
    of your opposition to marriage equality…..you are living in the past..governor cuomo had it right..when
    he said its about respecting others and their life
    choices..but what i want to know is why you and others
    of your ilk always revert to a personal attack using
