WHITE PLAINS, NY and YONKERS, NY — U.S. District Judge Cathy Seibel will be besieged by former Nick Spano’s legal counsel, Richard Levitt and Kerry Lawrence, as well as letters written by relatives, colleagues, and friends beseeching the leniency of the court by suggesting Mr Spano receive a maximum of 6 months' imprisonment and an additional 6 months’ home confinement. Federal guidelines call for a sentence of between 12 to 18 months.
It was on February 10, 2012, that Mr Spano pleaded guilty to a charge of $53,000 in income taxes that he claims were an error and oversight that took place over an eight-year period beginning with the year 2000. Other charges were ignored and remained unacknowledged.
Those who have pleaded for leniency on behalf of the former New York State Senator include former Yonkers Mayor John Spencer, former New York State Assemblyman Louis Mosiello, former Elmsford Mayor Robert Williams,and a letter from his younger brother, the present Yonkers Mayor, Mike Spano.
Nick Spano is scheduled to appear before Judge Seibel on June 18, 2012.
