YONKERS, NY – June 27, 2012 — Richard Narog and Hezi Aris will discuss Yonkers Mayor Mike Spano's "re-submission" of the mayor's adopted FY2012-2013 budget that did not earn New York State Comptroller Thomas DiNapoli' certifying the budget. Since Mayor Mike Spano's FY2012-2013 Proposed Budget was adopted unanimouly by the Yonkers City Council, and the adoption process earned a motion by which the "Motion to Reconsider", a Robert's Rules of Order" technicality that precludes vising the vote, as well as the issue first voted, can the Yonkers City Council vote on a revised or resubmitted rendition of the first adopted budget? To side-step this concern, is the Yonkers City Council entitled to vote another time on a document that it may only vote upon once as per the term which precludes them: the "Motion to Reconsider"? Since the NYS Comptroller is the determinant of whether the budget meets the tenets he deems abides by certain guidelines and tenets set in law and protocol, will he suggest the first budget considered, which thereafter underwent a second time under the "Motion to Reconsider" define and designate the first document as void abonitio, that is "void from the beginning"? If one is to recognize that incorporating the "Motion to Reconsider" precludes the Yonkers City Council from reconsidering the first document, will it also be considered that no "budget" document may be considered in the same callendar year by the Yonkers City Council? If not, has the 2012 Yonkers City Council played itself into a role of neutering itself and thereby permitting a defacto Control Board?
