may be too late to submit another potential logo for the City of Yonkers
recent “YoLoGo Contest”, but given the twisted, misrepresented, and duplicitous
statements spewing forth from City Hall these past few months, a good choice
would be “Spin City.”  Taking a page from
the king makers in Albany, Yonkers City Hall has engaged the services of
professional Spin Doctors to craft lies and bend the truth. This is a
propaganda technique that may work well in Albany, but it won’t work here in
Yonkers where the people are smart enough to figure out the truth themselves.


In
light of some of the lies and spin that City Hall and its Spin Doctors have put
before the citizens of Yonkers, below is an alternative, but time honored and
respected public relations technique – the truth.

  • Yonkers Firefighters are
    NOT the highest paid Firefighters in the United States.  In fact, several Fire Departments right here
    in Westchester County pay their Firefighters more in salary than the Yonkers
    Fire Department.  Yonkers Firefighters
    have a current hiring rate of approximately $71,000 and reach top salary of
    just over $78,000 after three years.  We
    are not ashamed of that salary, especially given the dangerous profession we
    work in and in light of the fact that we live and work in one of the most
    expensive Counties in America.  There are
    many Fire Departments in the region that pay their firefighters significantly
    more than the City of Yonkers, even New York City.
  • Yonkers Firefighters do
    NOT work less hours per week than any other union worker in the United
    States.  In FACT, Yonkers Firefighters
    work a 37.5 hour work week, more hours per week than any other unionized employees
    in the City of Yonkers. 
  • Yonkers Firefighters do
    NOT have the most expensive contract in the United States.  In FACT, the Yonkers Firefighter’s contract
    is comparable to the contracts of many other Fire Departments in the region and
    is significantly less generous than Firefighters contracts in other areas of
    the country.   While many Firefighters
    throughout the region and the country do not contribute to the cost of medical
    insurance coverage, for almost 2 decades the Yonkers Firefighters have been
    contributing as much as 50 % of the cost of their health insurance
    coverage.  EVERY Yonkers Firefighters
    pays at least 10% of the cost of a family plan or 20% of the cost of an
    individual plan.
  • Yonkers Firefighters do
    NOT abuse sick leave.  The FACT is that
    day-to-day non line-of-duty illnesses and injuries are at multi-year low
    levels.  Unfortunately, some Yonkers
    Firefighters are stricken with serious ailments and injuries such as cancer,
    brain injuries, heart problems, back problems, and other types of debilitating
    injuries and diseases.  As a result, a
    few dozen Firefighters utilize the bulk of the total Firefighter sick
    leave.  The balance of the Firefighters
    do occasionally get sick or injured and utilize sick leave accordingly, but
    there is no systemic abuse of sick leave in the Yonkers Fire Department.  If there was evidence of any sick leave
    abuse, then why have there been no disciplinary actions taken against even one
    single Yonkers Firefighter over the past year? 
    The answer is that sick leave is not being abused and the City is using
    understaffing and alleged sick leave abuse as an excuse for not properly
    staffing and funding the Fire Department.
  • Yonkers Firefighters
    never did, and never were intended to, respond to EVERY single call for
    emergency medical assistance.  The FACT
    is that there have been protocols in place since the inception of the First
    Responder
    Program that dictate the types of emergency medical calls that
    Yonkers Firefighters are designated to respond to.  These calls are limited to actual life
    threatening emergencies such as heart attacks, strokes, choking, allergic
    reactions, diabetic emergencies, child births, etc.
  • No additional
    Firefighters were hired or added to shifts as a result of the Yonkers
    Firefighters taking on the responsibilities and duties of the First Responder
    Program in 1993.  The FACT is that there
    were AT LEAST 54 Firefighters working per tour for over 50 years before that
    time.  What the First Responder Program
    did ensure was that there would not be less than 54 Firefighters working on any
    given tour as long as the First Responder Program was in place.  This “minimum staffing” level was later
    increased to 57 Firefighters with the restoration of the Rescue Company in the
    year 2000.
  • Yonkers Firefighters are
    NOT entitled to get paid a medical stipend if their medical certifications have
    lapsed or expired.  The FACT is that a
    Firefighter is only entitled to be paid a medical stipend if he or she has a
    valid certification on file with the Fire Commissioner.
  • Yonkers Firefighters are
    NOT to blame for the projected $7 million to be spent on overtime in the
    Yonkers Fire Department this fiscal year. 
    The FACT is that the Fire Department currently has almost 45 vacant and
    unfilled Firefighter positions due to retirements in the past two years. These vacancies
    amount to approximately 12 % of the entire Firefighting force.  The City has failed to hire additional
    Firefighters needed to fill these vacant positions, but instead has decided to
    fill these vacant positions with Firefighters on overtime.  As a result, the overtime budget has ballooned
    and now the City wants to blame the self-created overtime spending on the
    Yonkers Firefighters and Local 628. 

In FACT, the City had
almost $2.5 million remaining from a SAFER Grant from the federal government
which was to provide funding for as many as 21 Firefighters through February,
2013.  This money was available to the
City since February 2011, but since March of 2012 the City has not utilized
this money to hire desperately needed Firefighters.  As a result, the City is currently “in
default” of the terms of the SAFER Grant and has jeopardized the remaining $2.5
million of the grant, and could possibly be required to repay over $2 million
that was already provided to the City prior to Mike Spano taking office.  All of this, in an attempt to gain leverage
with Local 628 in contract negotiations and to make the Fire Department look
too expensive to continue providing the life saving services it has provided
for many, many years.

  • The City did not “win a
    victory” in Court on January 2, 2013, or on any of their previous Court
    appearances regarding the pending legal proceeding initiated by Local 628.  In FACT, the City (or should I say Mike
    Spano) suffered a resounding and humiliating defeat (again) in Court.  The Spin Machine may make every attempt at claiming
    victory in Court, but the truth is that NYS Supreme Court Justice Sam Walker
    was the 8th Judge who has sided with Local 628 and ruled against
    Mike Spano.
  • Mike Spano’s actions have
    already risked public safety and if allowed to implement his current plan, Mike
    Spano’s policies will further endanger public safety and the safety of the
    Yonkers Firefighters.  The FACT is that Mike Spano first endangered both pubic safety and
    Firefighter safety over six months ago when he reduced the number of Battalion
    Chiefs in the City from two to one and eliminated the “Safety Division.”  Both of these positions are critical to the
    safety of the public and the Firefighters. 
    In fact, many similarly sized cities actually have more personnel
    performing these functions. 

The second Battalion
Chief was reinstated several months later, but only after Local 628 filed
Improper Employer Practice charges with the New York State Public Employees
Relations Board (PERB) and the union representing the Fire Officers went to
Court and sued Mike Spano over the reduction in the number of Battalion
Chiefs.  The City and the Officers’ union
settled the lawsuit with Mike Spano agreeing to immediately reinstate the
second Battalion Chief.  Mike Spano has
yet to reinstate the “Safety Division” and Local 628 has recently declared to
PERB that we are at “impasse” with negotiations with the City over the Safety
Division.  PERB recently appointed a
mediator to attempt to resolve the impasse, but the City’s attorney appeared
alone at the first meeting and was unprepared to resolve the issue and in fact
totally misrepresented the underlying facts to the mediator.  The mediator had no choice but to reschedule
the mediation session and instructed the City’s attorney that on the next date
he is to bring people with him who have knowledge of the issues and who have
authority to speak on behalf of the City. 
If the matter is not resolved through the mediation process, Local 628
has every intention to request Interest Arbitration over the dispute before an
Independent Arbitrator who will be empowered to issue a final and binding
decision on the abolishment of the “Safety Division.”

Mike Spano’s plan to
eliminate the Fire Department’s First Responder Program will similarly endanger
the safety of the public and the Firefighters. 
The First Responder Program has saved countless lives during its over
20-year existence, both civilians and Firefighters.  Any plan to eliminate and/or reduce the First
Responder Program will result in a significant reduction in public safety and
Firefighter safety.  In 2012 alone,
Yonkers Firefighters delivered 84 shocks using an Automated External
Defibrillator.  This is in addition to
the numerous times they performed CPR, and treated serious condition ranging
from strokes to mothers in labor.

The unspoken goal of Mike
Spano in eliminating the First Responder Program is to reduce the number of
Firefighters per shift and therefore to close two of the City’s 18 Fire
Companies.  Indeed, if Local 628 had not
secured a Temporary Restraining Order against Mike Spano back in the summer,
Mike Spano had already designated Tower Ladder 71 (New School Street) and
Engine Company 312 (Fortfield Avenue) to be closed.  The closing of these two essential Fire
Companies would be disastrous and would significantly endanger the lives of the
public as well as the Firefighters, and even more so because the decision of
which two companies to be closed was based solely on political calculations and
was not decided by anyone with any experience in, or knowledge of, the City’s
fire load and occupancies, or fire science in general.

  • The Yonkers Firefighters
    and Local 628 have neither stonewalled nor otherwise engaged in stalling
    tactics.  In FACT, Local 628 and the City
    were originally scheduled for arbitration over the subject of the first
    Temporary Restraining Order (“TRO”) (reducing manning levels per tour) on
    October 4, 2012. Just a couple of days before this scheduled arbitration, the
    City (not Local 628) requested that the matter be adjourned. Local 628 consented
    to the City’s request and joined the City in requesting that the arbitrator
    postpone the arbitration. But it was the City, NOT Local 628, who wanted to
    adjourn the arbitration. Local 628 was ready, willing and able to proceed on
    October 4, 2012 and had numerous witnesses ready to testify on our behalf on
    that day and to have the arbitrator render a decision. Local 628 has not and
    will not stonewall or otherwise cause any delay in bringing this dispute to
    resolution. In fact, in all of Local 628’s court papers and legal arguments we
    have requested expedited arbitration and proceedings.
  • Yonkers Firefighters and
    Local 628 have NOT been unwilling to sit down with the City and attempt to
    negotiate in good faith to resolve our differences.  In FACT, Local 628 has met with Mike Spano,
    personally, on several occasions and has met with members of Mike Spano’s
    administration on even more occasions, all in a good faith effort to work out a
    successor agreement to our current contract which expired on June 30, 2009.  In FACT, Local 628 presented the City with several proposals which would have saved the City
    millions of dollars in the future and which would have lessened the costs of
    the very modest salary increases we were also seeking for the past 4 years and
    for the next 3 years. Unfortunately, to date, the City has failed to come to
    the negotiating table with reasonable proposals of their own.  The City believes that if they can’t force
    Local 628 to enter into another contract to their liking that they will just
    violate the current contract.  Hence the
    reason for all of the contract grievances, court orders, and arbitration
    hearings. 

There
are not enough pages in this newspaper to counter every lie that has been told
about the Yonkers Firefighters and Local 628 over the past 12 months.  I hope this has cleared up some of the
misconceptions and lies that have been fed to the public.  Local 628 will continue to correct the record
as needed and we will do so at www.yonkersfirefacts.com.  All of the FACTS stated within are verifiable
and can be backed up with proof.  Ask
Mike Spano if he can say the same about his so-called “facts.”

  1. Half of the guys you listed are not even related. maybe the reason there are brothers on the same job is because they know what a good job it is. you take a test/physical and get a ranking. They start at number one and hire in order till the list expires. There are no band scoring like the police do where they skip thru people to reach who they want. look at the police if you want to see nepotism. if it was easier to get hired, don’t you think bill fitz kid would of got hired?

    1. Bill fitz kid is hired and as yfd knows helping the “handicapped ” in more ways than the average citizen can imagine. nepotism in the YFD is at least done respectfully. If you’re going to bring it up at least bring up public works where family relations is a good start but you better have the cash on hand too.

    I am the mother of 2 YFD firefighters. My sons took tests, scored high and were hired. How DARE you demean their efforts. How Dare you accuse my family of nepotism. (My family IS the YFD) My eldest encouraged his brother to become a firefighter. It is an honorable job-a tough job. One you are probably not up to. I believe some of the “same names” are not only NOT related, they are not of the same race. When a firefighter goes into a burning building, I pray there is enough manpower to cover him and his “brothers”. We need your support.

  7. I’m not sure why you are quite upset over this topic. You are the only person to say word one about Emperess Ambulance Corporation. Just trying to stir the pot Mike? You must really be losing your footing. Pathetic attempt to sway the topic off on another tangent. Keep this in mind. Emperess is usually happy to have us there. This I have heard first hand from actual employees of the company. Considering the 10 minute window, the 4 minute average response time of the YFD, and the fact that you are talking about the lives of taxpayers and voters I can’t understand why you would want to endanger their lives. The first person who sues the city for wrongful death will have a great case. Actually I heard the city already set aside funds for just that. Nice way to run the city and take care of your constituency.

    “Ok gonna open up. Have been keeping an eye on this topic and must say I’m getting quiet upset over the negative comments being said about a company I work for. In no way have I ever been more upset with YFD then I was yesterday. All they did was stand there and watch as we tried to make a life saving decession. The only thing the officer on this unit could say is “make up your minds. We are outta here.” And took him and his manpower and left. At times I enjoy having the fd there to help. If you don’t want to help then stay in quarters. Oh and for the record by the time a unit gets to the scene its usually about 5min. Unless tied up attempting to clear from a previous call. So keep the negative response times to yourselfs.

  9. Lol half these people aren’t even related, maybe wake up yonkers has been getting his information from the mayor. All these years I thought it was my high scores on the tests that enabled me to become a firefighter and my prompting (with his high scores) for my brother to become one. I guess wake up Yonkers knows nothing about the state role in lists or where most of the recruiting is done. Current firefighters often try to get friends and family to take the test as most recruiting is done in south Yonkers.

  12. Only white men have to score high on the exam to get hired. Minorities including those with black or brown skin or possessing female genitalia are given preference by a federal judge to get hired rather than based on physical and mental qualifications.
    Don’t you feel safe and secure Yonkers??? The federally appointed female firefighter could not drag a 200lb unconscious man out of a three-story burning building but a federal judge ruled that Yonkers discriminates in hit hiring.

    Reductions in fire brigades must be a reduction in protection unless we can also cut our police ,sanitation and schools and say it is still all good there is a problem here and it belongs in the mayors office. Where is the fire brigade brass on this issue?

That’s because the YFD are treated as second class citizens in this municipality. At least under the last two administrations. But you wouldn’t know anything about that. Save your ignorant comments for people who don’t know any better. Perhaps you should try your act at the local pre-school. They may have time for your nonsense.

No. 1: NYS handles all testing and hiring of civil service employees. No2: Not everyone with the same last name is related. No3: YOU should have run a little faster!!!

  16. I hope Mike Spano lives to be 100 years old and spends the rest of his life regretting the day he betrayed the Yonkers Firefighters.
    His first mistake was allowing Governor Cuomo to install Sue Gerry as Deputy Mayor so he and Larry Schwartz could call the shots in Yonkers and Mike Spano would be left to do the ribbon-cutting and the handshaking. There’s no question that Cuomo through Schwartz through Gerry is running and ruining Yonkers.
    Way to go Mike. Your parents must be proud of the loyal and standup guy you are. You know, all that Semper Fi stuff. You’re not even a microscopic piece of sand off of the old block.

Everyone on the Yonkers Fire Dept. takes a civil service exam which is corrected up in Albany and sent down to Yonkers to finalize with Seniority points, Veterans points… Any way most of those names on that list are not related as to there last names. I have been on the job for over 20 yrs. and thats a fact A-HOLE cause I know all of them.

    And to be frank I think it’s fair to lump in Kathy Spring SPENCER and Zehy JEREIS’ wife into the list of SPano patronage jobs. And it doesn’t stop there. The best part about these bunch of appointed employees is that they took NO TEST, GET PAID MORE THAN FIREMEN AND OFTEN DO NOTHING AT WORK.
    Gig is up Mikey Boy. The word is out that while Nick is in prison you’re as good as a 4 year old hiding under his blanket afraid of the monsters in the closet. They don’t call you Dumbo and Fredo for nothing I guess.
    And the sad part is I don’t even like the foiafightas but right is right. You all deserve each other!

    I dont think any local boys would have enough sway to get a federal judge or whomever sees to its implementaion change it for them?
    But we are getting off base, why is the mayor seeking to change the response of fire brigades to ems call to save money? That is the best remedy you can choose? How did Amicone trim the fire budget without removing the response of fire brigades(before the tax hike and reintroduction of brigades, they cut and still went on ems runs)? Why cant spano do the same. Just a vendetta? We will loose out on this service. Stop the kid games and just lead.

  22. This list is not at all news worthy or of any relavance. I grew up with a family that had uncles brothers cousins etc. in the electrical field, cops have along history of relatives following in their fathers and grandfathers footsteps, and this goes for teachers, postal workers the list goes on and on. I see your point “Wake up Yonkers”, but I don’t see where this constitutes anything illegal or immoral? Now back to what the article was meant to prove our Mayor your Mayor is a spin doctor to put it politely. After following this story for the last year I won’t be as proffessional as Mr. McGoey this Mayor is an out and out liar. To bad he will not be in the room when the arbitrator hears both sides.

  23. The YFD does not use and has never used banding. You are hired based on scoring. I believe. The YPD uses a banding system but I could be wrong on that. Any suggestion that it is otherwise is a pure lie from someone who apparently wants to be a Yonkers FF but can’t pass the test.   25. There is no family more apt to benefit from NEPOTISM then the SPANO families…..YPD, at least has a civil service testing process. How bout those APPOINTED positions in city hall, dpw. Like a guy bringing his new boss a cake box with an envelope in it.
    Go to any municipality and you’ll find the same as YO. New Rochelle, W.P. both have the same. Families of employees has a natural inside knowledge and advantage.

  28. Many “Relatives” got in with grades well below those who scored higher, but were not within that High Percentile who had to be taken. Thus, because of NEPOTISM, they got in.
    It is a practice that has been on going within the department for decades and everyone KNOWS that it will happen again when this latest group is hired.
    FOR THOSE WHO THINK THAT BECAUSE THEY SCORE HIGH ON THE LAST TEST THAT THEY WILL GET IN, ARE IN FOR A RUDE AWAKENING.

  29. If I am not mistaken, all civil service tests and lists are public imformation. Years ago you were hired stricktly by how you score on the written test, and if you passed all subsequent testing. I believe they hire now in a banding system, where say 95-100 is ine band, 90-95 is aonther and subsequent bands until they reach the failing mark. The city is allowed to start hiring anyone within the top band, but cannot go to the next band until all those in the next higher band has been hired.With respect to police and fire it is not uncommon for children to try to follow in their parents footsteps and take the test in their respective parents department. It is done all over the country. So there is no nepotism in the hiring, or promotions, but just like any other job, there is in giving out assignments.

    Maybe the UNION will ask for that European Spa down at Station 8, next to McGoey’s leather appointed office that he has (Does his family member get the office next door?)

He actually e- mailed these lies to all city employees! Could legal action or a public admission/apology be demanded?

  32. Mr. McGoey just let the abitrator handle this issue because the Mayor has been given his orders from Presidential candidate Cuomo. Misiformation and sound bites, by the Mayor’s office, has shown to hold no weight in the courts.
    Also, what happened to the Mayor’s appointed O.T. czar? I heard he wasn’t going to be Ms. Gerry’s puppet.
    The Mayor has shown no oversight of the B.O.E., which has an operating budget more than 10 times the size of the YFD budget. He seems to be ok with the B.O.E.’s efficiencies or lack there of.
    Don’t waste anymore time with this Mayor unless the arbitrator is in the room. Mike Spano is such a tool!

  37. It’s amazing how the Spano Spinners are on this blog trying to change the argument from the facts that Local 628 has brought to light in response to Mike Spano’s lies and more lies.
    McGoey calls it as he sees it and he never says anything he can’t back up. As someone who is very familiar with the FD I can tell you that everything McGoey has stated is the truth and that most of what Mike Spano says about the fire department is a lie.
    I can’t wait to see Spano’s stupid face when he loses and doesn’t know what to do next. The fire brigade is going to relentlessly dog Spano until he is destroyed. It’s already begun to happen, but Mikey doesn’t even know it and he won’t know what hit him even when it does.   43. Question for wake up yonkers, is the state civil service system allowing nepotism such as fixed scoring, jumping over candidates and the such. If so that is big and should be reported to state attorney general. But I think there is a consent decree in yonkers handled by the feds who control the whole shabang? If so it has been the federal courts or someother oversight agency messing up? I would contact them and give them a heads up if you really think this stuff goes or went on? Or could it be that families tend to tell each other about the jobs ands testing standards in place and try the same path? It is a small city namewise sometimes.
