If they were acting in concert with each other, Koch would be charged with Conspiracy as well. Vera being a Police Officer is unable to write and swear out a warrant, due to Yonkers Police Dept past practice. Vera has to go to a Detective for a warrant. Vera then lied to Koch about the details of his investigation. Koch then constructed a warrant based on Vera’s information and swore to it because that’s Yonkers Police past practice and why would one cop ever think the other is lying to him.
