Yonkers Board of Ethics Gave Written Permission Informing Councilman Rubbo That He Need Not Recuse Himself From Any Issue Coming Before the Real Estate Committee Chair Over Which He Presides As Its Chairman

Yonkers City Councilman and Real Estate Chair John Rubbo (D-YCC-District 4).

YONKERS, NY — December 12, 2021 — The donations afforded by Councilman Rubbo’s landlord, AMS LLC 86 Main Street of Yonkers, NY, are legal and within the maximum permitted as noted below for the June 9th, 2021 donation AND likewise by the donation by AMS Group LLC  of Englewood, NJ. Each AMS entity as noted is entitled to donate to any campaign effort they choose. They are separate entities. Were there additional AMS entities, 5 more, 20 more, or even 100 more, et al, they would each be permitted to support the campaign effort of their choice as voted upon by their board of directors within the maximum permitted limits as set by law. In this case, in every aspect of the Councilman John Rubbo’s Campaign effort was ascribed to and met legal standards.

The standards, guidance, and directive defined for Councilman John Rubbo are noted herein:

14 June 2021: $2,000 AMS Group LLC 55 Jones Rd Englewood NJ 07631-3731 United States C – Monetary Contributions Received From All Other Professional/Limited Liability Company (PLLC/LLC) Campaign to Elect John Rubbo – ID# 8469 2021 State/Local July Periodic.

With respect to the allegations that were raised regarding Yonkers City Councilman John Rubbo (D-YCC-District-4) relationship with AMS:

(1) on December 2, 2020, Councilman Rubbo submitted correspondence to the Board of Ethics (“BOE”) requesting an advisory opinion on whether he can serve as the Chair of the Real Estate Committee and/or vote on matters appearing before the City Council relating to AMS;

(2) On January 13, 2021, Councilman Rubbo appeared before the Yonkers Board of Ethics to answer questions concerning, inter alia, or his relationship with AMS;

(3) On February 24, 2021, Yonkers Corporation Counsel issued an advisory opinion to the Yonkers Board of Ethics concerning the foregoing along with outside legal counsel; and

(4) The Yonkers Board of Ethics, after fully considering and deliberating the matter including Yonkers Corporation Counsel’s opinion, subsequently adopted a Resolution No. 1-2021 (approved 5-0) finding that “there is no ethical prohibition with respect to Councilman John Rubbo taking action on behalf of the city, provided that he continues to fully disclose his relationship with AMS to the satisfaction of the Ethics Board, prior to taking any action on matters related to AMS.”

The document issued by the Yonkers Board of Ethics on December 2nd, 2020, was ascribed by Dennis Gallegos, Yonkers Board of Ethics Secretary.

What follows is the Yonkers Board of Ethics webpage retrieved and posted on the City of Yonkers Website today, December 12, 2021.

Purpose: Renders opinions on potential conflicts of interest; requests and reviews confidential disclosure statements of city officials.

The Ethics Board is established by Section C1A-23 of the Code of Ethics of the City of Yonkers. Its duties include: investigation of ethics complaints, conducting hearings, recommending disciplinary action, rendering advisory opinions, administration of City employee disclosure statements and providing ethics training for city employees.

This is a 3 year term. All members are appointed by the Ethics Board Appointing Committee (Mayor, presiding Judge of City Court & City Council President), without City Council Advice/Consent.

  1. So what is the point of having a board of ethics ? His landlord does substantiate business with basically him as chair- while also saying “ oh, yeah I’ve received donations to keep me in office by the same entities that I owe rent to !
    These guys don’t see a possibility of ANY conflict!!!
    Oh, stupid us it’s Yonkers “ city of hills,where nothing is on the level”

      The Board of Ethics hasn’t met in months. Judge Nocca is deceased but the Board of Ethics website has not been updated. The decision gave Rubbo a pass. Shame on the Board of Ethics.

One hand washes the other in Yonkers-anything involving real estate and the Yonkers waterfront-Rubbo should remove himself because he potentially stands to benefit because of his business located at basically the waterfront-this is the same man who because of family connections received an IDA loan for his business while most Hispanic’s who applied for a loan would be pissing in the wind.

    1. Let’s talk about the Khader investigation which is based in fact., not innuendo.
      Mike Khader did not pay rent to Smith Bis and Jacobs, while using the office for his law practice and campaign headquarters. Until Khader can provide documented proof of rental payments, he is in violation of campaign finance laws.
      I would expect an MBA from Iona to understand this.

    2. how about his campaign disclosures??? who paid harris beach llp the lawfirm that defended his election lawsuit he bought on???? CRICKETS…..

      Can we see his landlord lease and payments????
