YONKERS, NY — March 25, 2022 — The FindLaw Staff defined New York Consolidated Laws, Election Law – ELN § 17-122 as noted herein specifically toward misconduct in relation to petitions. The Election Law is current as of January 1, 2021 and has been updated by the FindLaw Staff

ELN § 17-122 Stipulates the following… (Words in bold  are so defined to make understanding of the law as simple as possible. Even so, words that are not in bold follow as delineated by ELN § 17-122 without omission.)

1. Pays, lends, contributes or promises to pay, lend or contribute any money or other valuable consideration to or for any voter, or to or for any other person, to induce such voter to sign a petition for the designation of a candidate for party nomination or for election to a party position to be voted for at a primary election, or to induce such voter to sign a petition for opportunity to ballot at a primary election or to induce such voter to sign an independent nominating petition for public office;  or

2. Gives, offers or promises any office, place or employment, or promises to procure or endeavor to procure any office, place or employment to or for any voter, or to or for any other person, in order to induce such voter to sign a petition for the designation of a candidate for party nomination or for election to a party position to be voted for at a primary election, or to induce such voter to sign a petition for opportunity to ballot at a primary election or to induce such voter to sign an independent nominating petition for public office;  or

3. Receives, agrees or contracts for any money, gift, loan or other valuable consideration, office, place or employment for himself or any other person, for signing a petition for the designation of a candidate for party nomination or for election to a party position to be voted for at a primary election, or for signing a petition for opportunity to ballot at a primary election or for signing an independent nominating petition for public office;  or

4. Pays or agrees to pay money or other valuable consideration, to any person for his services in canvassing for or otherwise procuring the signatures of voters to a petition for the designation of a candidate or candidates for party nomination or for election to a party position to be voted for at a primary election, or to a petition for opportunity to ballot at a primary election, or to an independent nominating petition for public office, upon the basis of the number of names to such petition procured by such person, or at a fixed amount per name;  or,

5. Represents to any person as an inducement for signing a petition for the designation of a candidate for party nomination or for election to a party position to be voted for at a primary election, or for signing a petition for opportunity to ballot at a primary election, or for signing an independent nominating petition for public office, that the person soliciting such signature is to be compensated upon the basis of the number of names procured by such a person, or at a fixed amount per name;  or

6. Being a signer of a petition, provided for in the election law, for the designation or nomination of a candidate, or a petition for opportunity to ballot at a primary election, thereby makes a false statement or makes a false affidavit thereon, or a false statement to the witness who authenticates the petition;  or

7. Being a notary public, commissioner of deeds or a subscribing witness to a petition, provided for in this chapter, for the designation or nomination of a candidate, or a petition for opportunity to ballot at a primary election, thereby makes a false statement or makes a false affidavit thereon;  or

8. Alters a petition, provided for in the election law, for the designation or nomination of a candidate, or a petition for opportunity to ballot at a primary election, by inserting, adding or changing therein the name of a candidate, or the title or designation of an office or position by any means whatsoever, after such petition has been signed by one or more persons, is guilty of a misdemeanor.

  1. I look forward to Breen winning this election. Not that there is anything wrong with Nader Sayegh, it is just time for someone else to have a chance. Mike Spano will appoint Gordon Burrows to fill Mike Breen’s seat. It is quite a large seat so he may appoint two people.

  2. Not only does Mike Breen has a better than even money chance to beat Nader Sayegh, Nader is fast becoming the underdog. This will be the first real race and Sayegh will collapse. He lacks the mental acuity to win.
    He has aligned himself with the far left wackadoodles.
    This race presents a moral dilemma for Fred Polvere.

    1. Funny you used a gambling metaphor. As a result of Nader’s Racing and Wagering Committee work, he is bringing home a full table license for Empire City in the upcoming budget, which Yonkers has been asking for since Al DelBello was Mayor 50 years ago. Thousands of good-paying union jobs, and millions more for Education Aid. This past month, he passed legislation protecting consumers from utility companies, and forced the Governor’s hand on divesting NY’s pension funds from Russian businesses after their invasion of Ukraine. What has Breen done lately?

      He had to call News 12 and tell them that he wasn’t the New York Knicks announcer after they used the wrong headshot of him, and illegally offered people breakfast if they signed his petition sheets.

  3. The facts are that Mike Breen will be on the ballot come November and this will be a competitive race. As well the NYS Governors race between the Congressman and the incumbent. She’ll have to dump her No.2 for he’s a liability. Also, Astorino needs to give it a rest already. In a Republican primary he’ll be crushed. Onslaught on Long Island Zellers home turf.

  4. Hey Hezi, I heard Breen pulled out all the stops and has the Teamsters collecting his signatures. No one in the Republican party wanted to get signatures for Breen.

      I don’t know if the Teamsters collected signatures on behalf of Breen. I was surprised to learn that some Republican politicos did not carry petitions on his behalf. Kindly, Hezi

  6. Good luck to Mr. Breen. It will be nice to have a fresh voice in Albany. As to the allegations, look at Diaz . Khader, and Pineda-Issacs. Mike is a boyscout in comparison.

  7. Breen doesn’t have the required petition signatures to get on the ballot. The republicans led by the incompetent Larkin are panicking last minute. There is sure to be a lot of funny business in how they get “signatures”. An election lawsuit should follow.

  8. Last weeks council meeting was a disgrace. The pledge of allegiance took longer than the meeting where the rubber stampers, voted on everything without even one question. This is where their integrity comes in. Breen could not vote on the receiving of money for the “new” training center, as he has 2 on the force. It was typical Yonkers nonsense to watch this in action.

    Not one question on the cost of the training center and the need for it. Not One. In reality another building no matter who it is for will cost the taxpayer dearly, as it will have to be staffed and will cost money to run. No questions there on the cost to the taxpayer. Ah! Ya Gotta love Yonkers, always growing the government.

    Disgraceful all around. Just wonder if anyone else on the council should also recuse themselves on the vote. It didn’t go unnoticed money also came from Shelley, and the guy in the audience wearing the Spano Oil T-shirt as a free advertisement.

    None on the council were thinking of the taxpayer. NONE. All happy to be done in mins. What a great gig!!!!

    1. Kind of ironic that Breen could not vote for the training facility because he has two kids on the job-yet he had no problem voting for and nearly tripping over himself when he voted for the new Yonkers P.C.

      Because his conduct as noted by his advertisement at attend a bagel shop for a bagel and coffee to sign his petitions are illegal. That is not an attack. It is an attack that exposes his lack of legal acumen despite many sources who could have advised him what is and in this case IS NOT illegal. This sort of “ignorance” exposes his belief that no matter what he does, he will suffer no repercussions. There is rationale for the laws on the books. As I have noted before, if there is no interest to abide by the tenets that make up law and standards, perhaps they should be rescinded. Perhaps Mr. Breen can work on changing the standards to which he refuses to abide. — Kindly, Hezi

    But when he talks about high taxes I shake my head he’s voted for every single tax and fee increase that exist

  12. Personally I don’t think it is a big deal, but as hezi poignantly makes note of in the past, Breen is positioning himself as the law and order candidate. Then maybe he should follow the law! Breen breaking the law shows his true colors- a lying politician with no value…

    Bagels and petitions aren’t what I expected you to devote a column on . The shenanigans Sayegh’s team has pulled thru the years are worse. Pleading No Contest to Election Fraud. No reason to go on with more. Let them fight it out in the general election . To me I wouldn’t vote for neither. They only care for themselves and jobs for their families.

  14. Breen running is nothing but a Spano move to get rid of Nader. Whatever is left of the Yonkers Republican is employed by Spano. John Larkin the Republican Chairman is employed by Spano and so are his two children. Spano succeeded on eliminating khader and now its Nader, the community won’t forgive Spano, your term limited.

        Very interesting comment. I gather you did not read the advertisement promoting the free bagel and coffee so as to be enticed to the bagel shop to sign the petition for elected office. I have to presume you did not comprehend his “promise” to potential Republicans and Conservatives and thereby you could not decipher that the LAW does not permit such a promise and inducement be engaged. Is that how you arrived at the “bullshit charge”? Perhaps you recognize how valid it is but you seem assured that no one in Yonkers will prosecute on the integrity of what has been divulged. Your assertion that the issue is “bullshit” is not a charged, it is a fact. There is no lawyer that can defend your assertion that the issue is “bullshit”! It is quite evident that the bagel and coffee enticement offered by the Breen campaign is a desperate attempt at trying to get enough signatures on the ballot. Then again, Mr. Breen exhibits a lack of insight with respect to election law as you evidently do as well. There are lawyers in the City of Yonkers who could have and would have shown Breen the “law”. Perhaps Breen and his entourage believe they are invincible and untouchable by the law. Even if that was so, which it may very well be, because that is how Yonkers too often rolls, would you cast you vote for such a failed character? It is simply shameful no matter how much you feel you are right, the law advises you are wrong. If the issue is irrelevant then it is time for New York State to change the rules which it presently has not and that “sir” is no “bullshit!”.

            You are correct about one thing, that is that in your comment you do not describe what you are offended by what the Khaders have done. It is meaningless innuendo because there is no substantiation of any kind, not even your take on what is offensive, it at all. I admit that I am tired of reading diatribes that explain nothing, yet are thrown about to castigate people 20 hears after the fact. Where were you, where water Yonkersites to question conduct or behavior that they did not agree too. Crickets were the only creatures to be heard. And just became people share a name, does not mean they are related. That goes for Americans whose last name is Johnson, or whose last name is shared because those who entered America did not know if the application was asking for a last name or a first name. But whether related or not, did those who sought a job have the capacity or the interest to do the work required, or is it simply a no show job? I am certain Yonkersites know one from the other?   15. I called Highridge Bagels today and asked them about Breens petition drive
    The owner was not aware of it , all he said was that Breen asked to pass out fliers.

  16. It’s unfortunate that Yonkers does not have a ethics board to look into the rampant corruption that occurs in City Hall , Yonkers would need its own wing in Federal Prison. We have a political inspector general and a ethics board that doesn’t exist. It’s really a shame with all the perks these council members get, Lakisha’s job at MHA is unethical, corazon double dipping two jobs, Tasha Diaz thinks taxpayer dollars are meant for her personal use, Rubbo’s landlord is embedded in Yonkers while he chairs real estate, Breen abuses his car while gas is $4 a gallon.

    1. And let’s not forget Khader getting free rent while pretending to care about the little guy. Thankfully they got rid of him.

It would be nice to knock on doors and explain to the voters why you extended term limits to pad your pension after the voters in District 5 wanted to 2 terms. The best is let your Republicans know that your the TAX KING of the GOP. I look forward to see you get embarrassed.

    1. Republicans and Dems both voted for term extensions, against the will of the people of Yonkers. Both parties in Yonkers are corrupt and completely self-serving and the abuse of power only gets worse. No oversight, locally or state-wide!
